I’ve just been charged in a criminal case. Now what?

In this day and age, there is clearly no such thing as a “minor” criminal offense. Minnesota, like many other states, has ratcheted up criminal consequences over the past years. Putting aside the obvious consequences like probation, fines and fees, jail, and even prison time, some criminal cases such as DUI/DWI, drugs, assaults, and sexual conduct carry collateral consequences that aren’t always obvious on the surface.

You need to talk to someone who understands the complicated law surrounding your criminal charge. Give O’Brien & Wolf a call! The attorneys at O’Brien & Wolf will listen to you, answer your questions, and inform you of your options. Best of all, we offer a free initial consultation. No charge, no commitment—just honest advice from an experienced criminal defense attorney, so you can understand your case and potential consequences. If you decide to retain O’Brien & Wolf to represent you, we can usually get your case opened and get to work within a day—now that’s service.

What kind of criminal cases does O’Brien & Wolf handle?

A good question with an easy answer: all of them. Experienced criminal defense attorney Jacob Allen has vigorously represented clients in virtually all types of criminal cases including all drug and DUI/DWI cases, assaults, sexual assaults, firearm offenses, theft/fraud/property offenses, probation violations, and more. Attorney Allen is a seasoned trial attorney with a stellar representation for strong advocacy for those he represents no matter what their charge. Jacob Allen is also experienced in representing clients in the collateral consequences that come with some types of criminal charges. Cases involving DUI/DWI regularly come with license and license plate revocations, mandatory ignition interlock, chemical dependency evaluations, and even forfeiture of vehicles in certain cases. Some assaults can mean a loss of gun rights for the remainder of a person’s lifetime. Criminal sexual conduct cases require registration as a predatory offender, periods of conditional release, and mandatory sex offender treatment. Jacob Allen and the legal team at O'Brien & Wolf will help you understand your case, all the potential consequences, and listen to you to help best defend your case and preserve your rights.

Additionally, every person deserves a second chance to move on from their criminal past. Attorney Jacob Allen is known for his hard work representing clients who want to take advantage of Minnesota’s expungement and restoration of gun rights laws. Don’t let your past hold you hostage today—there may be a way forward!

Wouldn’t it be easier to just plead guilty and get it over with?

It certainly is easier to just plead guilty! In fact, that’s precisely what the State and prosecutor hope you’ll do. No work for them, but all the consequences and a conviction for you.

There are actually very few cases where it makes sense to plead guilty without first talking to a criminal defense attorney. Even if you think the case is “open and shut” with no defense, oftentimes a criminal defense attorney at O’Brien & Wolf can get you a better outcome. There may be an option for your case that you don’t see!

A criminal defense attorney's goal for each client is a simple one: To get for you the best possible result, using his decades of experience as a fighter for his clients and their legal rights. No matter how dire your case may be, you owe it to yourself to consult with Jacob Allen at O’Brien & Wolf to see the difference that having a strong advocate at your side can make.

I know I should retain a lawyer, but this is going to cost way too much, right?

You might be surprised! Don’t make the mistake of moving forward on your case without talking to us first. While retaining a good criminal defense attorney to represent you obviously costs money, O’Brien & Wolf’s goal is to provide for our clients the best “bang for your buck” that we can. O’Brien & Wolf’s strong history of client advocacy demonstrates we will do just that.

Individuals charged criminally need to think about the long-term cost of not hiring an attorney. Criminal records are public data in most circumstances, and, in this day and age, it is easy to look up an individual’s past history of criminal charges and convictions. Don’t underestimate how damaging a criminal past can be—especially when it comes to work and the ability to provide for yourself and your loved ones.

Ultimately, each case is different and the cost to defend each case is going to be different. Jacob Allen believes every person charged with a crime deserves a good attorney by his or her side, and will evaluate your case individually. We are committed to working with you to make your legal defense affordable.

Can’t I just use the public defender?

Having worked for years as a public defender before entering private practice a decade ago, Jacob Allen understands that public defenders have a hard job. They are overworked, underpaid, understaffed, and oftentimes go unappreciated.

Due to these conditions, Minnesota has tightened up public defender eligibility in recent years. If you have a job, or have assets that you own, it is unlikely that you will qualify these days for the services of the public defender in the first place. Even if you do qualify, you don’t get to pick your attorney—the public defender assigns you an attorney of his or her choice.

For those who may qualify for the public defender, Jacob Allen encourages people charged criminally to explore the possibility of hiring private counsel. Put simply: your criminal case is important. The consequences of crime are long-lasting and can affect you for years, even decades. You deserve the attorney of your choice to advocate effectively for your interests.

Oftentimes, friends and family are willing to help once they know what you are facing. O’Brien & Wolf is willing to do their part to make representation a possibility.
